The Employment Rights Act 2025

The Act is the biggest change to employment law in a generation and is being brought in gradually. Changes include stronger protection from unfair dismissal, day-one rights to some forms of leave, statutory sick pay from the first day of absence, changes to flexible working and zero-hours contracts, and more protection against harassment. Employers should review contracts, probation arrangements and policies as each part comes into force.

Practical tips

Keep notes of meetings. Deal with problems early and consistently. Don’t dismiss before taking advice, particularly if the employee has raised a complaint, is pregnant or on family leave, or has a health condition. And check your insurance: some business policies include employment legal expenses cover, sometimes with a helpline.

Employees and workers must be given a written statement of the main terms of employment from day one. A full contract goes further and protects the business on matters like confidentiality and restrictions after employment.

What is the Employment Rights Act 2025?

A major reform of employment law being brought in over several years, including changes to unfair dismissal, statutory sick pay, flexible working, zero-hours arrangements and collective redundancy. Check which parts are in force before relying on older guidance.

Should I use HR support or a solicitor?
