Professionals are expected to use reasonable skill and care. If they fall below the standard of a reasonably competent member of their profession, and that causes you financial loss, you may have a claim.

What you need to show
That the professional owed you a duty, that they breached it by falling below the required standard (usually supported by expert evidence), and that the breach caused you a loss that can be quantified. Causation is often where claims are won or lost.
The process
The Pre-Action Protocol for Professional Negligence sets out a letter of claim, a response period and an opportunity to settle before court. Many claims settle at this stage, sometimes through mediation. Where limitation is close, a standstill agreement can pause time while the parties talk.
Funding
Options include private funding, conditional fee agreements, and after-the-event insurance, and some claims attract litigation funding. Check whether any legal expenses insurance you have covers the claim.
Common questions
How long do I have to bring a claim?
Usually six years from the date of the negligence, or, if later, three years from when you knew or should have known about it, subject to a 15-year longstop. The rules can be complicated, so take advice early.
Should I complain first?
Complaining to the professional, and to an ombudsman or regulator where one exists, is often sensible and can resolve smaller matters. The Legal Ombudsman can deal with some complaints about lawyers. It doesn't stop the limitation clock for a court claim.
Who pays if I win?
Most professionals carry indemnity insurance, and claims are usually defended and paid by insurers.
