Your rights

Under the Police and Criminal Evidence Act 1984 and its codes of practice, you have the right to free and independent legal advice, to have someone told you’ve been arrested, and to see the codes of practice. You’re entitled to speak to a solicitor in private and have them with you in interview.

Voluntary interviews

Being invited to a ‘voluntary interview’ or ‘interview under caution’ is still serious. What you say can be used in evidence. You’re entitled to free legal advice and should arrange it before attending. Leicestershire Police interviews are usually held at a custody suite or police station in the county.

What the solicitor does

Before the interview, the solicitor gets ‘disclosure’ from the investigating officer, meaning an outline of the allegation and evidence. They then advise you in private whether to answer questions, give a prepared statement or say ‘no comment’, and attend the interview to make sure it’s conducted fairly. Afterwards they deal with bail and any charging decision.

After the interview

You may be charged, cautioned, released on bail, released under investigation, or told no further action will be taken. If you’re charged, the case will usually go to Leicester Magistrates’ Court first. Criminal legal aid for court proceedings depends on the case and your means.
